What is a leave application?

A leave application is a formal written request from an employee to their reporting manager and HR seeking permission to be absent from work for a defined period. In Indian companies, leave applications are typically governed by the company leave policy and the relevant state Shops and Establishments Act. While most organisations have moved to digital workflows, a structured leave application format remains useful for documentation, audit, and for unusual leave categories such as bereavement, marriage, paternity, or extended medical leave.

A well-drafted leave application captures the leave type, dates, reason, and handover plan in a single page that a reporting manager can approve quickly. It also serves as written proof when the company maintains leave records for statutory audit and Form 16 reporting. When to use this template

For everyday casual leave the company portal usually suffices, but a written application is recommended for any leave longer than three days, leave immediately before or after a public holiday, or leave requested at short notice. Legal considerations under Indian law

Leave entitlements in Indian establishments are governed primarily by the state Shops and Establishments Act, the Factories Act, 1948 (for factories), the Maternity Benefit Act, 1961 (26 weeks paid maternity leave), and the Code on Social Security, 2020. Companies must ensure that their leave policy provides at least the statutory minimum and that leave applications are processed without discrimination. Sick leave beyond a defined period typically requires a medical certificate. Refusal of statutory leave entitlements can attract penalties under the relevant Act and complaints before the labour authorities.

The Maternity Benefit Act, as amended in 2017, entitles eligible women employees to 26 weeks of paid maternity leave for the first two children, with shorter entitlements for subsequent children. Adoption leave of 12 weeks is also provided for adopting mothers of children below three months of age. Paternity leave is not a central statutory entitlement, but most professional Indian employers grant 5–15 days of paid paternity leave by policy. The leave application form should accommodate all these categories without requiring re-design.

How much notice should be given for planned leave?

Most company policies require 7–14 days advance notice for planned leave of three days or more. Sick leave can be applied for retrospectively with a medical certificate.

Can leave be denied?

Casual or earned leave may be denied or rescheduled for genuine business reasons, but statutory leaves such as maternity and bereavement cannot be denied.

What if I exceed my leave balance?
